Terms of Service

These Terms of Service govern your access to and use of the website, inquiry forms, project communications, proposals, digital services, strategic materials, design work, development work, consulting deliverables, and related service interactions provided by MOTO GT. By visiting this website, submitting a project request, requesting a quote, reviewing a proposal, approving a scope of work, or engaging MOTO GT for services, you agree to these Terms of Service.

1. Nature of Services

MOTO GT provides digital services for motorcycle-focused businesses, including website development, inventory system planning, service booking platform design, parts and accessories e-commerce solutions, CRM workflow structure, digital marketing support, rental and fleet management software planning, interface design, frontend development, operational dashboards, technical consulting, and related digital strategy services. Services may vary depending on the agreed project scope.

MOTO GT does not provide legal, tax, insurance, lending, financial, compliance, engineering certification, vehicle inspection, mechanical repair, dealership licensing, or regulated professional services. Any operational recommendations are provided from a digital business and technology perspective only.

2. Eligibility and Business Use

This website and the services described are intended for business use. You represent that information submitted through the website is accurate, that you have authority to submit information on behalf of the business or organization referenced, and that your use of the website does not violate applicable law, third-party rights, platform policies, or contractual obligations.

3. Project Requests and Proposals

Submitting an inquiry does not create a service agreement, guarantee acceptance of a project, reserve availability, or establish a fixed price. MOTO GT may review the submitted information and determine whether the project is suitable for its services. A project becomes active only after the parties agree to a written scope, timeline, payment structure, and any other applicable commercial terms.

Pricing ranges displayed on the website are general market-oriented estimates and are not binding offers. Final pricing depends on project complexity, features, integrations, content requirements, design depth, backend logic, data migration needs, third-party systems, revision volume, urgency, and maintenance expectations.

4. Client Responsibilities

Clients are responsible for providing accurate project information, timely feedback, brand assets, content, images, access credentials, technical documentation, business requirements, product data, inventory data, service descriptions, pricing information, legal text, policies, and approvals needed for the project. Delays in client input may affect timelines, launch dates, and delivery obligations.

  • Clients must have rights to all logos, images, fonts, text, product data, and materials supplied to MOTO GT.
  • Clients must review deliverables carefully before approval and launch.
  • Clients remain responsible for the accuracy of business, product, legal, and operational content.
  • Clients must not provide unlawful, misleading, infringing, or harmful materials.

5. Scope, Revisions, and Changes

Each project is limited to the scope described in the applicable proposal, invoice, statement of work, or written agreement. Features, pages, integrations, animations, forms, dashboards, data structures, automations, revisions, or support outside the agreed scope may require additional fees and timeline adjustments.

Unless otherwise agreed in writing, revision rounds are limited to the number stated in the proposal. Requests that materially change the original direction, add new functionality, require restructuring, or demand additional design and development work may be treated as change requests.

6. Payments and Invoices

Payment terms are defined in the applicable invoice, proposal, or service agreement. MOTO GT may require deposits, milestone payments, monthly retainers, or full payment before delivery depending on the project. Work may be paused if payments are late, disputed without cause, or not received according to the agreed schedule.

The client is responsible for any taxes, platform fees, subscription fees, hosting fees, app fees, third-party license costs, payment processing fees, or other external expenses unless the written scope specifically states otherwise.

7. Third-Party Platforms and Tools

Projects may rely on third-party platforms such as Shopify, hosting providers, analytics platforms, CRM systems, booking tools, email services, payment processors, advertising platforms, inventory software, map providers, plugin providers, and other external tools. MOTO GT is not responsible for outages, policy changes, pricing changes, data loss, account restrictions, integration limitations, or security issues caused by third-party platforms.

8. Intellectual Property

Unless otherwise agreed in writing, MOTO GT retains ownership of its pre-existing methods, frameworks, processes, know-how, reusable code patterns, design systems, technical concepts, internal tools, templates, documentation structures, and general business knowledge. After full payment, the client receives the rights described in the applicable agreement for final approved deliverables created specifically for the client.

Drafts, unused concepts, rejected directions, preliminary designs, internal notes, and experimental materials remain the property of MOTO GT unless specifically transferred in writing.

9. Website Content and Legal Compliance

Clients are responsible for ensuring that their website content, product claims, pricing, refund policies, privacy policies, terms, advertising claims, financing statements, dealership information, warranty statements, and service descriptions comply with applicable laws and regulations. MOTO GT may assist with structure and presentation but does not act as legal counsel.

10. Performance and Results

MOTO GT may design systems intended to improve clarity, conversion, performance, lead handling, operational flow, or customer experience. However, MOTO GT does not guarantee specific traffic levels, search rankings, revenue, advertising results, inquiry volume, customer behavior, sales outcomes, or business growth. Results depend on market conditions, pricing, offer quality, staff response, inventory, competition, advertising spend, customer demand, and many factors outside MOTO GT control.

11. Confidentiality

During a project, clients may share non-public business information, access credentials, operational details, customer process information, inventory data, or marketing information. MOTO GT will use reasonable care to protect confidential information and will use such information only for service delivery, unless disclosure is required by law, necessary to work with approved service providers, or authorized by the client.

12. Acceptable Use

You agree not to misuse this website, interfere with its operation, attempt unauthorized access, submit malicious code, scrape content without permission, impersonate another party, submit false information, or use the website for unlawful, harmful, fraudulent, or abusive purposes.

13. Limitation of Liability

To the maximum extent permitted by law, MOTO GT is not liable for indirect, incidental, consequential, special, punitive, or lost-profit damages arising from website use, project delays, third-party failures, platform outages, business interruptions, data issues, advertising performance, or service outcomes. Any liability related to a paid project is limited to the amount paid by the client for the specific service giving rise to the claim, unless applicable law requires otherwise.

14. Termination

MOTO GT may decline, pause, or terminate work if a client fails to provide required information, fails to pay, requests unlawful work, violates these terms, abuses staff, creates unreasonable project conditions, or demands services outside the agreed scope without appropriate adjustment. The client may also discontinue a project subject to the payment, cancellation, and refund terms in the applicable agreement and refund policy.

15. Updates to These Terms

MOTO GT may update these Terms of Service from time to time. The updated version will be posted on this page with a revised date. Continued use of the website or services after updates means you accept the revised terms.
